Credit Card Fraud
Credit card fraud is a white collar crime that is committed when someone knowingly uses another person’s credit card, without that person’s permission, to obtain property or goods. Like all cases involving fraud, a person committing credit card fraud will knowingly deceive his or her victim or steal from his or her victim in order to obtain monetary or material gain.
Credit card fraud is also technically considered a type of theft crime. When a person uses another person’s credit card without consent, he or she has stolen from the person. If the person uses the card to make purchases, he or she will be committing a theft offense. Due to the fact that credit card fraud is also a theft crime, if the person is caught, he or she can be charged with either a misdemeanor or felony. The severity of the charges will depend upon the total purchases the person made with the stolen credit card. For example, a person that merely stole a credit card but did not use it may be charged with a misdemeanor whereas a person that made purchases over a set dollar amount (usually $500) may be charged with a felony. And, like all felony offenses, the person may have to spend over a year in jail if he or she is convicted in the Texas courts.
